ORDER

In accordance with the decision of the Judicial Panel on Multi-District Litigation
to transfer the claims relating to the Apalachicola-Chattahoochee-Flint (ACF) River Basin
to the United States District Court for the Middle District of Florida, the court ORDERS
as follows:

(1) All claims regarding the ACF Basin are severed and DISMISSED without
prejudice. This case will proceed as to the claims concerning the Alabama-Coosa-
Tallapoosa (ACT) River Basin only.
(2) Based on the verbal representations made at the April 18, 2007 status
conference and the court’s independent review of the pleadings in this case, the court
concludes that the State of Florida has no claims before this court that relate to the ACT
River Basin. Consequently, the State of Florida is DISMISSED as an Intervenor plaintiff
in this case.

(3) On or before May 4, 2007, the Lake Lanier Association shall show cause why
it should not be DISMISSED as Intervenor defendant with no interest in the ACT River
Basin dispute.
